On April 21, 2024, the FBI executed a search warrant at Smith's Manhattan apartment. The search resulted in the discovery of an SD card containing hundreds of explicit videos. Smith was subsequently charged with one count of distribution and receipt of explicit content, carrying a mandatory minimum sentence of five years and a maximum of 20 years in prison. He also faces one count of possession of such content, with a maximum sentence of 10 years[1].

Smith will be presented before U.S. Magistrate Judge Robyn F. Tarnofsky in Manhattan federal court. The case is being handled by the Office's General Crimes Unit, with Assistant U.S. Attorney Getzel Berger leading the prosecution[1].
